IM Branding® is licensed to You (End-User) by The Miles Foundation, Inc. dba Best Place for Kids!®, located at 5049 Edwards Ranch Road, Suite 280, Fort Worth, Texas 76109, United States. This Privacy Policy and End User License Agreement describes our policies and procedures regarding the collection, use, and disclosure of your information when you use our Service.
Child Safety and Zero Tolerance Policy
Prohibition of Child Sexual Abuse and Exploitation (CSAE)
Zero Tolerance Policy: IM Branding® has a zero tolerance policy towards Child Sexual Abuse and Exploitation (CSAE). As used herein, "Child Sexual Abuse and Exploitation" and "CSAE" refer to any activity involving the abuse or exploitation of minors, including the production, distribution, or possession of child sexual abuse material (CSAM). Any content, actions, or communications that involve or promote CSAE or CSAM in any form are strictly prohibited on this platform.
Prohibited Conduct
Users must not engage in, solicit, produce, distribute, or facilitate the creation or dissemination of any content that exploits, harms, or threatens to harm children. This includes, but is not limited to:
- Any form of child pornography (as defined by 18 U.S.C. § 2256) or depictions of children in sexually explicit conduct
- Any content that sexualizes minors or is intended to solicit personal information from minors
- Engaging in activities or transmitting communications that victimize or intimidate minors in any way
Reporting and Enforcement
Users are encouraged to report any suspected violations of this policy to IM Branding® through our designated reporting mechanisms. IM Branding® will review all reports and take appropriate action, which may include reporting to law enforcement agencies, removing content, and permanently banning users found to be involved in such activities. All reports are treated with strict confidentiality.
Legal Compliance
IM Branding® complies with all applicable laws concerning the protection of children, including cooperating with law enforcement agencies in their efforts to combat CSAE. IM Branding® has a legal obligation to report any detected CSAM to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement agencies, in compliance with the PROTECT Act (18 U.S.C. § 2258A).
Application Information
IM Branding® is a piece of software created to support Fort Worth parents and caregivers, customized for Apple mobile devices. It is used to view and access community resources.
Scope of License
You are given a non-transferable, non-exclusive, non-sublicensable license to install and use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules and the App Store Terms of Service.
License Restrictions
You may not:
- Share or make the Application available to third parties without prior written consent
- Reverse engineer, translate, disassemble, integrate, decompile, or attempt to derive the source code
- Copy or alter the Application except as expressly authorized
- Remove any intellectual property notices
User Generated Contributions
The Application may invite you to contribute content. When you create or make available any Contributions, you represent and warrant that:
- Your Contributions do not infringe proprietary rights of any third party
- Your Contributions are not false, inaccurate, or misleading
- Your Contributions do not contain material that solicits personal information from anyone under 18
- Your Contributions do not violate any applicable law concerning child sexual abuse material (CSAM)
- Your Contributions do not include offensive comments connected to race, national origin, gender, sexual preference, or physical handicap
CSAM Reporting Process
IM Branding® maintains a comprehensive process for handling reports of child sexual abuse material:
- Staff Training: All relevant staff receive initial and annual refresher training on identifying CSAM and legal obligations
- Verification Process: All reports undergo verification by trained professionals
- NCMEC Reporting: Confirmed CSAM is immediately reported to the National Center for Missing and Exploited Children through their CyberTipline
- Law Enforcement Cooperation: Full cooperation with law enforcement authorities as needed
- Content Removal: Immediate removal of confirmed CSAM and permanent ban of involved user accounts
- Record Keeping: Detailed records maintained for minimum of five (5) years as required by law
Technical Requirements
The Application requires firmware version 1.0.0 or higher. We recommend using the latest version of the firmware. You are responsible for confirming that your device satisfies the technical specifications.
No Maintenance or Support
The Miles Foundation, Inc. dba Best Place for Kids!® is not obligated to provide any maintenance, technical, or other support for the Application.
Warranty
We warrant that the Application is free of spyware, trojan horses, viruses, or any other malware at the time of download. The Application works as described in the user documentation, subject to the limitations outlined in this agreement.
Liability
Licensor's responsibility in case of violation of obligations and tort shall be limited to intent and gross negligence. In case of breach of essential contractual duties, Licensor shall also be liable in case of slight negligence, but liability shall be limited to foreseeable, contractually typical damages.
Termination
The license is valid until terminated. Your rights will terminate automatically if you fail to adhere to any terms of this license. We reserve the right to terminate your access immediately, without notice, if you are found to have violated any provisions related to child sexual abuse and exploitation (CSAE).
Legal Compliance
You represent and warrant that you are not located in a country subject to U.S. Government embargo or designated as a 'terrorist supporting' country. You agree to comply with all applicable laws, including those related to child protection, data privacy, and content regulation, such as the PROTECT Act (18 U.S.C. § 2258A).
Applicable Law
This license agreement is governed by the laws of the State of Texas, excluding its conflicts of law rules.
